Questions, answered.
Common questions on divorce law. For anything specific to your matter, write to the firm.
How do we file a divorce in India?
The procedure depends on the mode of divorce. In a mutual-consent divorce, both husband and wife are willing to divorce, and may even hire a common lawyer, though separate lawyers are advisable for unbiased advice. A contested divorce is filed when one party is unwilling to divorce.
What are the grounds for filing a divorce?
The main grounds include cruelty (physical or mental, including repeated denial of sex and impotency), adultery, desertion for a reasonable period, mental disorder, conversion of religion, and renunciation of the world.
What is an ex parte divorce?
The term ex parte means without the presence of the other party. An ex parte divorce can be granted only in a contested divorce, where only one party is present because the other refuses to participate or cannot be located.
What is an NRI divorce?
An NRI divorce involves a couple living abroad. NRIs may file either in the country of residence or in India. These matters are complex, as parties may face difficulty attending court proceedings; time is of the essence and the solution must be cost-effective. As an international firm, we have expertise handling cases across jurisdictions.
How is child custody dealt with?
While deciding the rights of the child, their welfare must be kept foremost, and with rights come responsibilities. Physical custody, visitation rights and the financial rights of the child must be wisely settled before going for a divorce.
What are 498A proceedings?
Section 498A IPC safeguards women against acts of cruelty by the husband and his family after marriage. Cruelty is widely interpreted to include both mental and physical cruelty, coercive unlawful demands, dowry demands and harassment. The provision carries imprisonment of up to three years along with a fine.
